​Bill 25

​Bill 25, implemented in Quebec in September 2022, aims to protect personal information and ensure that it is handled in a secure and privacy-respecting manner. The following is a summary of the key provisions of the Act and the risks faced by businesses in the event of non-compliance

​Obligations for companies

​Managing Privacy Incidents

​In the event of an incident, businesses must keep a record of all events and take steps to reduce the risk of harm to affected individuals. They must also notify the Commission d'accès à l'information and the persons affected in the event of a serious risk of harm.

​Biometric verification

​Businesses must disclose to the Commission any verification or confirmation of identity carried out using biometric characteristics or measures.

​Disclosure of Personal Information

​The new rules govern the disclosure of personal information without the consent of the individual concerned in the course of commercial transactions or for the purposes of study, research or the production of statistics.

​Designation of a Responsible Person

​Companies must designate a person responsible for the protection of personal information and publish their contact information on their website.

​Governance rules

​Bill 25 requires organizations to adopt rules governing their governance with respect to personal information and to be transparent about it.

​Risks to businesses in the event of non-compliance

​Financial penalties

​Companies risk significant fines for non-compliance with the law. The minimum fine is $5000, but it can be much higher.
